Now the consequences of that strict policies are being faced by the candidate who recently got graduated from the university and have applied for the H-1B visa. Candidate can only work in the US if after  F-1 visa gets expired they applied for H-1B visa and got a job offer from a US employee. A candidate who comes to the US on study visa wishes to continue working in the US after completing his studies for financial or growth reasons. But with the delay in the processing, the students can’t work in the US until they have H-1B working visa. Companies which hired the students are taking their steps back on it as the visa status of the candidates is still pending. Moreover, if they continue staying in the US on expired study visa they will come under the protocol of Unlawful Presence. Unlawful presence could lead to deportation and the US government can ban the entry of the candidate in the US.

The only and costlier way out for this is to get engaged in other classes to maintain the status of F-1 visa.

  • Students after completing study are given Cap Gap to work under OPT program and wait for the pending H-1B visa. This time the Cap Gap expired on October 1, 2018.

  • USCIS failed to process all the visas before October 1 owing to the piled cases.
  • It is being continuously said that the government should allow premium processing as the USCIS is not capable to deliver it on time.

A Benefit of the doubt is with the government as they have a valid reason for the delay. It is very difficult to tell whether the delay is by mistake or it is intentional. Everybody knows very well how Trump administration changing policies to curb immigration. Whatever it may be but the future of the students is uncertain in the US.
