During his Second Term as President of USA, Trump laid significant emphasis on immigration enforcement, Immigration and Customs Enforcement (ICE) swung in action and deported over 5,25,000 deported over illegal immigrants in first 9 months of Trump taking over presidency. With this, more than 2 million of undocumented immigrants were deported including 1.6 million who self-deported voluntarily.
It is now a daily reality for estimate 51million plus immigrants in US facing raids in workplaces, communities as Temples or Gurdwaras, while attending ICE hearing or even schools. There have been many instances where school children reporting their class fellows to ICE for them to conduct raids and deport them. While undocumented immigrants are specifically living under stress worrying about detention or deportation, immigrants having legal status too are not immune. In one odd case, a documented immigrant was picked up from market and taken in custody as he was not carrying the requisite papers to prove his legal status.
In the USA, one mistake is all it takes to get deported.
For valid visa holders, green card holders, or the undocumented, one misstep such as a traffic violation or expired paperwork is enough to get you deported.
There are many other triggers for one to get deported and worst of all the way deportation is being carried out there are few remedies, and one is destined to face detention horrors before getting deported and exposed to economic ripple effects.
Official standpoint is that only the immigrants that are illegal, threat to Public Safety or National Security would be deported
Deportation grounds are laid down in the Immigration and Nationality Act (INA), and immigrants identified as threat to “public safety” or “national security” are to be deported expeditiously however in practice, only 5% of ICE detainees have violent convictions and 73% have no criminal record at all, with most cases tied to immigration status alone.

About 40% of the deportees are convicted of such offenses.

A B-2 tourist visa holder where overstaying by even one day faces a 3-year bar and those overstaying for 6 months face bar for 10 years.
Undocumented entry? Immediate removal. Asylum seekers are worst affected under this provision.
Due to AI deepfake scrutiny, such cases have seen steep rise and those convicted for sham marriages, fake documents, previous conviction in home country as sex offender are barred from re-entry for life.
Status Non-Compliance-Green Card holders living abroad for period exceeding 6 months:
Living abroad for a period exceeding 6 months as a Green Card holder (more than 35000 immigrants have been deported as on date for staying longer than 6-month period), change of address but not reported, switching job without USCIS approval are good enough charges to deport an immigrant.
Protecting yourself against Deportation
Once charged of any offence, deportation is inevitable, well almost.
If you think, there is any possible reason for you to get deported, consider taking following precautions:
- Keep digital backup of all your records; Approvals, Visas, applications; Job records, property papers, passports to encrypted cloud,
- Be a part of a stringer community network who can stand besides you in case of any trouble;
- Be careful in complying with local rules and laws as driving carefully, some driving offences which easily go unnoticed in your home country, are not acceptable in US.
- Keep contact of Reputed Immigration Lawyer ready, just in case of any eventuality;
- Setup alerts for ICE raids. Consider setting up Apps like Notifica or any other such app in your mobile that allows immigrants to quickly send preset alert messages to family, friends, or legal contacts in case of an emergency especially situations involving immigration enforcement (ICE).
- Understand your rights as “I don’t consent to searches”, Film interactions (legally). Carry a laminated “Know Your Rights” card from ACLU.
- Stay away from Immigration Scams. Don’t fall prey to attorneys that offer “guaranteed” green cards.
- Keep financial backup for 3-4 months of emergency

Due process is your constitutional right though about 90% of illegal immigrants lose cases. After a Notice to Appear (NTA), you get a master calendar hearing which you can use to plead your case.

Be careful in selecting the right attorney and stay away from lawyers that promise “instant green cards” for $1,000–$5,000 upfront, then disappear. No ethical attorney guarantees outcomes. Report to FTC/USCIS Tip Form against any such scam attorney you come across.
Free or Low-Cost Alternatives to fight deportation
There are some nonprofit organizations that handle cases pro bono. Some of them are:
- National Immigrant Justice Center (NIJC) that offers free consultations and represent low-income people.
- Florence Immigrant & Refugee Rights Project (FIRRP) offers free social/legal aid.
- Immigrant Defenders Law Center (ImmDef) offers free deportation defense.
- Immigrant Legal Resource Center (ILRC)
- USCRI Humanitarian Legal Services provides low-cost services for refugees.
