Many times, a person’s entry ticket into the US is synonymously identified with their US Visa. A lot of people assume that by having a visa, they are automatically entitled to entry into the US but that’s not true. You can be denied entry to the US despite having a valid visa. A travel document that is issued to any foreign national who wants to visit the US is called the US visa. The holder is permitted by the visa to travel to the port of entry,  airport, or a land border where there is a necessity to get permission from the Dept. of Homeland Security or the Customs & Border Protection to enter the US.

 

A visa, however, doesn’t guarantee entry into the United States. A visa just means that you have been qualified by a consular officer to obtain entry under a specific visa type.

The personnel of DHS/CBP are in charge of any traveler’s admission and are accountable for permitting any foreign national to remain for a specific duration in the US. A visa gives a foreign national the consent to apply for entry into the US. The visa validity indicates the period of time that the foreign national is permitted to travel in the US to any of the ports of entry. 

The single entry visa allows one-time permission to a foreign national to travel to the port of entry. It is allowed from the issue date to the date of expiry.

The multiple entry visa could be used multiple times from the issue date until the expiry.

In case you have a visa and enter the US, yet you are refused entry by an immigration official, you can demand your case to be reviewed before a judge. But, if you are traveling as a visitor to the US, under the visa waiver program, then you can waive the right of an appeal of any immigration officer regarding your admissibility, or even contest the action in deportation.

If you are having a visa, then you will be having the right to:

–  Get an exclusive hearing in front of a judge to decide on your admissibility;

– Get yourself an administrative appeal with the Board of Immigration Appeal;

– Get a judicial appeal or review of either any or every decision mentioned above
