A family in way of deportation got the decision in their favour.

According to a latest report, a local family that was facing deportation has been granted permanent residency in Canada. Their scheduled deportation at the end of July has been cancelled.

The Brampton couple and their two children, the youngest with Down’s syndrome, are a happy unit now, after the fear of certain deportation. Daniel Carnales said that Citizenship and Immigration Canada has decided that the family can stay in Canada. In the telephonic interview, he said that they have agreed to review the case. It should be noted that the family’s request for permanent residency has been rejected at least three times prior to this.

The family got support from The Defence for Children International-Canada, Brampton-Springdale, MP Ruby Dhalla and others in the community.

The family came to Canada in the year 2001, and is originally from Uruguay. They own a house in Brampton and they have been living there for almost four years now. For four consecutive years after arriving here, Daniel worked as a carpenter in a construction company. Later, he switched to a transportation company and is working there till now at the post of general manager. His youngest son, Aaron was born in Canada. Aaron is suffering from Down’s syndrome. The family fears that if they are forced to go back to Uruguay, then it might hamper their child’s health, since services over there are far inferior than available in Canada.

Earlier, refugee status and legal immigration status requests by the family on humanitarian ground were rejected. Following this, the case was taken over by lawyer Leigh Salsberg, of Toronto based Jackman and Associates. Salsberg appealed against the refusal to allow the family to stay on humanitarian grounds and the deportation was postponed. After the notice of appeal, the government also decided to review the case on humanitarian grounds, Salsberg said.

Immigration officials remained silent on the issue, and said that they cannot comment because of privacy laws. However, Carnales said that his lawyer has told him that the government has allowed the family to stay. He said that the kids were very happy after the happy news. He also said the family wants to thank every one who supported then during the course of the case.

Defence for Children International-Canada spokesperson Matthew Geigen-Miller said that the decision identifies and promotes the rights of the children and this will really help them in time to come.
