What does “Canada Immigration Law” has in store for the “Aspirants”?
Immigration laws of Canada changes so often that in no time an eligible person become non-eligible and vice-versa.
It was in 2002 itself that the entire immigration act which was in force since 1976 was replaced with a new Immigration and Refugee Protection Act (IRPA).
With the introduction of the IRPA, there were many major changes in the laws, and the general public reflected the opinion that the new laws were not Canadian. Many individuals and groups demonstrated against the new immigration policies. Finally, due to the class action law suit, the government was forced to amend the policies. The pass marks for a subject category was also brought down to 67pecent. This was the lowest ever pass mark for any category.
It was clearly evident that there was a deviation from the earlier concept of demand based selection process in the IRPA. According to the IRPA, the application of any applicant irrespective of the occupation’s demand, if meets the marks requirements, would be accepted in a first come first serve basis.
Now, almost six years later, the department of citizenship and immigration, realized that with the help of the current policies, the problem of labor shortages is not been solved. With the current situation in view the conservative government of Canada, proposed significant amendments in the IRPA. The new Bill C-50, if passed would provide the minister of citizenship and immigration power to accept application forms of the skills in demand in Canada and also delay or even return other applications.
In the current situation it is really impossible to predict the outcome of any professional skilled worker category application that is made after february27, 2008. Even though the bill C-50 has been passed, but the uncertainty is likely to continue as there are various factors to have a look at.
Since the tabling of billC-50, various uncertainties have crept into and speculations on its unspecific implications have mounted. The reform is tied up in the budget implementation bill and is therefore a matter of confidence before the Canadian government.
Now it would be really interesting to see where the Canadian immigration rules are heading. Now all the people who are willing to migrate to Canada will have to wait till the final formal announcement is made, before they can really start preparing for their move to enter the territory of Canada.
