Now, immigrants need to live more cautiously in the United States as it is expected that the Obama administration would introduce drastic immigration policy reform. Immigrants need to be extremely cautious while seeking legal advice in matters related to immigration. Stated below is some useful information that would make few things clear to you.
Who can represent you to the USCIS as per the law?
Any of the stated categories can represent a person who is permitted to representation-
1. Attorneys in the US- This comprises of attorneys in the United States who are good standing members of the bar of the highest court of a State, territory, possession, Commonwealth or the District of Columbia. The same should not be under the affect of court suspension, subjected to retraining, enjoining, dismissal, or any order that restricts him or her in law practice.
2. Students of law and graduates of law who have not been admitted to the bar till now- This comprises of law students who have joined any accredited law school or are graduates from law schools but are not admitted to the bar till date, if:
- The concerned person is appearing following a request from the person permitted to representation.
- If he or she is a law student, the person must file a statement regarding the participation, under the direct command of a faculty member, licensed attorney, or official representative.
- If he or she is a law graduate, the person must file must have filed a statement that the appearance is under command of a licensed attorney or an official representative.
- The appearance of the law student or the law graduate is allowed by the official in front of whom the person wishes to appear.
3. Individuals who are reputed- Any person who is reputed and is known as a person with good moral character is allowed to be a representative, if:
- The appearance is at the request of the person permitted to representation and is just on an individual case basis.
- There is no involvement of any direct or indirect remuneration and the same should be filed as declaration.
- He or she is a relative of the person entitled representation.
- The official before whom he or she has to appear has allowed the appearance.
4. Any person who represents a non-profit religious, charitable or any organization of this kind established in the US and which is accepted by the Immigration Appeals Board are allowed to provide representatives for clients in cases regarding immigration.
