The Canadian federal court rejected the appeal of American army to stay in Canada.
The court has come up with the ruling that would allow the deportation of deportation of war deserters to United States.
Robin Long, a US war deserter appealed in the federal court of Canada to accept his stay in Canada, but he received mere disappointment. Justice Anne Mactavish has said that the appeal was not heard because Robin Long was not able to come up with substantial proof that he would face irreparable harm if he goes back to US.
Robin Long, who is 25 years old now, fled from US to Canada because US army wanted him to take part in the war in Iraq, and Long’s ideology considered this war to be illegal and futile.
As per Mactavish, the number of cases of persecution of deserters has increased since 2002, but still the large percentage of war deserters have not met with persecution due to desertion. So, one can not even imagine jail as the option for desertion.
Canada federal court of Canada has granted stay on the deportation order of the US National Guard Corey Glass, and the court is yet to decide whether it would hear this case or not.
These two individuals are amongst the 200 war deserters of America, who fled to Canada because they did not want to serve in Iraq. As per the current status of the case, the court and immigration officers are not in favour of granting refugee status to these war deserters.
