Undocumented immigrants cannot have guns-Court

This has been stated by a recent ruling by a US appeals court.

Undocumented immigrants cannot possess arms--Possession of arms Undocumented immigrants are among certain groups prohibited from owning guns as per the laws by Congress, the federal appeals court revealed.

Undocumented immigrants enjoy only limited protection under the US constitution, states the 10th Circuit Court of Appeals in Denver this Monday.

The ruling by a panel of three judges in Denver stated that not just undocumented immigrants, the US bars possession of firearms even for non US citizens who are here on visas for valid reasons.

So, possessing weapons can land undocumented immigrants in the US to jail. Non citizens like those in the US on non-immigrant visas are restricted from possessing arms or ammunition, the judges wrote.

They maintained that the only exception to this ruling is if they (non US citizens or foreigners on non-immigrant visas) are hunters or law- enforcement officers or diplomatic officials on business in the US or have any special waiver.

Undocumented immigrants must have equal rights as US citizens—Attorney argued--The ruling comes after an appeal by an attorney for Emmanuel Huitron-Guizar of Wyoming, an undocumented immigrant who was arrested last year.

He pleaded guilty of possessing firearms as an undocumented immigrant. He was held at Natrona County Detention Center by immigration officials.

Huitron-Guizar was sent to prison for 18 months as per the US law that prohibits undocumented immigrants from owning a gun.

When his prison term comes to an end, he is going to be handed over to US immigration officers for deportation proceedings.

Huitron-Guizar’s attorney, Ronald Pretty of Cheyenne, Wyoming had maintained that undocumented immigrants must be extended equal rights as enjoyed by US citizens in terms of buying a gun for personal protection as well as hunting.

He further appealed that undocumented immigrants must not be excluded from possession of arms and ammunition. Attorney Pretty states that his client Huitron-Guizar does not have any criminal history and has no ties to Mexico.

So, he is planning of making an appeal to the US Supreme Court, informed Attorney Pretty.
