When a permanent resident gets married to a person who is not American will have to stay apart for the period the visa gets processed. There are quite a few ways to get your spouse to be with you, but, each of these take quite some time. You may have to wait for as long as 6 months to actually bring your wife.
To begin with one has to file an application at US office and then filing an application at US consulate in the foreign country. However, if both the US citizen and the spouse live in another country than US then both the applications has to be made at US Consulate of spouse’s country.
The Form to be filed
One has to file Form I-130 with USCIS. This should be supported by a bona fide certificate proving the existence of marriage.
The officials would be happy to see a joint asset or finance like a joint bank account or even a joint telephone bill.
Officials would also prefer to have secondary documents like couple photos; wishes and messages form family and friends.
When the foreign national spouse is abroad
It is all the more important to prove that the couple is in regular contact. And to prove this one has submitted letters, electronic mails and other such documents to confirm their togetherness, in spite of being apart.
If the American spouse has visited the spouse in foreign country, then air tickets and related documents should also be produced.
It may take a year or even more to get the form processed, meanwhile make sure that you submit every possible document that supports your marriage along with Form I-130. This will save time as the officials will not be asking you to submit more evidence and waste time on that.
The brighter side is that the backlog for spouse quota of permanent residents range from a week to two. So, effectively a spouse will have to wait for not more than a year to get visa.
The options open for you
While the visa is processed one can think of obtaining “visitor’s visa” and spend some time with the pose in USA. However the foreign national spouse needs to assure the US Consular officer about holding a residence abroad and the intention to come back as well.
For those who wish to pursue higher studies, the option of coming on student visa is also open.
The brighter side
There is a proposal in the Senate about immigration that some relatives of the citizens of US can come to the country and can wait to get an Immigration Visa.
Marrying a US citizen and entering the country could be a time taking process and a couple may have to wait for some time before they live together. However, other options of spending time together can also be explored. For this a thorough research needs to be done by the applicant.
