Marriage Based Visa Application

following are the types of Visa applications based on marriage

Visa applications based on marriage

According to the rule of Canadian Immigration a permanent Canadian can immigrate his would be or exiting partner if he agrees to sustain him for three years to ten years. In other words the permanent resident has to support his incumbent partner till the time they establish themselves.

Different types of marriage based Visa have been discussed below-

-K1 Visa
It is meant for engaged couple. Here one person is a permanent resident of US and the other person can enter the country legally. One may take a time of 7.5 months to receive the Visa. The cost would be $1805. It takes almost 12 months to acquire “permanent resident status”.

The process is faster and quicker but one has to apply for Advance Parole (AP) if one intends to travel outside USA.

-K3 Visa
It is also called Spousal Visa. It allows a non US individual to enter the nation only if he or she is “legally married” to a permanent citizen of USA. The immigrant can accept “permanent resident status” is wishes to do so. The cost for such Visa is $1705. The time to acquire “permanent resident status” is about 14 months.

Based on this Visa one can apply for social security card and an Employment Authorization Document too.

For any reason if the marriage fails during the “status adjustment stage”, then one has to leave the nation.

-IR-1/CR-1
This is also a kind of Spousal Visa. When a non US citizen gets married to a permanent citizen of US then this Visa allows legal entry of the former person to US. Automatically he or she gets the status of “permanent resident”. It may take of time bout 9 months to get this Visa. The expenditure is about $945.

An individual can apply for jobs without getting Employment Authorization Document. He does not need to take any special permission for leaving the nation. The immigrant is regarded as “Green Card Holder”.

Separation from family might be for a longer period.

-Direct Consular Filing
The required paperwork is filed at the “Consulate” itself. One can become “permanent resident” in a short period of 3 months. The cost of application is $945.

It is the quickest route to enter US legally.

The Consulate policies keep changing with a direct impact on availability of Visa.

Before getting married to a permanent resident of USA one can look into the laws and understand the possibility of getting a Visa.
