Making an application for Labor Market Opinion (LMO) is mandatory for a Canadian employer willing to hire foreign workers on a temporary basis.
LMO in hand will enable an employer to post vacancies for hiring workers from foreign lands. It also gives the immigrant applicant the trust that there are no Canadian workers available to fill up the vacancy and hence an immigrant can apply for the job opening.
The importance of applying for LMO
This application is needed to hire a large number of workers originating from foreign land and it saves an employer from a lot of hassles in the complex recruitment process.
The approval process
After an employer meets all the requirements you can submit your application to the nearest Service Canada Center. When approved, an employer would receive a positive LMO. An employer must remember to provide a copy of confirmation letter to each of the foreign workers being hired by you. This is needed for them to make an application to get a work permit.
Making an application
• To understand the system an employer must refer to National Occupational Classification (NOC). This gives an idea of skill level of occupation.
• An employer can place in an advertisement regarding job opening, but, Service Canada reserves the right of altering the advertisement. The first preference would be given to Canadian employees.
• There is a privilege wage rate, and an employer has to follow this. He has to pay according to this list or he can even more than this.
• For some of the occupations a lower level of training can also be accepted.Some of these occupations are workers for seasonal agriculture, full time care givers and a few more occupations.
Employers need to prove
An employer needs to prove that he is hiring a foreign worker under the Temporary Foreign Worker Program for a given period of time. He can hire people from abroad only if he has made all attempts to fill up the vacancies with the natives and yet there are vacancies left.
Thereafter they can post the opening for a required job.
More criteria to be met by the Employers
In case an application for LMO has not been made then an employer must provide a business license or even a permit which will help the immigrant to come under the TFWP.
For those who have previously applied for LMO and need to make another application, need to prove that all the conditions were met by them before while hiring foreign workers.
As an Immigrant needs to meet a series of requirements for coming to Canada and join a work, even an Employer also needs to fulfill a length of requirements. This is needed to ensure that the rights of Canadian natives are reserved and also the Immigrants coming from foreign countries are hired through a technical and legal process. In the absence of such a mechanism the hiring of immigrants might not have been a methodical process.
