Different classes of Spousal Based Immigration to U.S.


Every year a number of Visas are provided to numerous immigrants under spousal and marriage categories. This has been very prolific recent years and has gained much attention.

To those who want to get their loved ones with them in U.S. these Visas are much helpful and has made a great number of open and easy paths for many immigrants. Generally there are two main categories of marriage Visas.

1. Fiance Visa or K-1.
2. Spouse Visa.
The spouse Visa is further categorized in three classes. These are as follows:

a. Spousal Visa (K-3).
b. Spousal Visa (IR-1 / CR-1).
c. Direct Consular Filing.

A general comparison of all these types is necessary for a newcomer before smearing his or her application. As by the name Fiance or K-1 is based on engagement status of a couple only. An approximation time for approval of Fiance visa is near about seven and a half months. As a rule this requires adjustment of status which means normalization in given time of 12 months plus Employment authorization document in case of willing to work in U.S. also.

In K-1 category for option of going outside of U.S. in the given period one should have an Advance Parole. The AP document is your authentication key to reenter in U.S. without any hurdle, is provided by United States Citizenship and Immigration Services (USCIS). Total estimated cost of K-1 is USD $1805 and after entering must get married and file for AOS in 90 days which excludes ensuing of illegal status.

K-3 or spousal Visa is only for married status. By this a non U.S. person can be called to states if his or her partner is already settled in U.S. As a rule the approximate time for processing of this Visa is just over nine months. It also requires EAD but not AP for the option of leaving or reentering U.S. The estimated time of legalization is over a year and two months. Total cost in just 1705 U.S. Dollars and has the option of acquiring AOS in two years maximum.

Spousal Visa (IR-1 / CR-1) is another category for marriage immigration under Spousal Visa category. As per rules the status is only for married persons. The normalization time is same nine months as for processing time. Best part is it does not require obligation to have adjustment, EAD or AP even. Cost for this Visa in fewer than thousand dollars. Also the Visa holder becomes permissible spontaneously. He or she can even travel freely in or out of U.S. under this category.

Final category is Direct Consular Filling. This process comprises course of IR-1/CR-1 Visa by reducing necessary wait requirement of USCIS department. Even all the credentials are completed in Consulate rather than that in USCIS department. For qualifying this, applicant must be a bona fide U.S. legal citizen with transparent proof of his or her citizenship.

The benefit for this is the pacey rout to get normalization which is just three months for processing too. It also costs fewer than thousand dollars. As this is only for those U.S. citizens who live overseas but the bottom line is the proof of Legal U.S. citizenship like a Domicile is required. Further polices of Consulate are in shift continuously. So it is obligatory to determine earlier that whether the Consulate will carry on this process in time of application or has changed its policies at that moment.
