Applicants from various countries are getting their applications refunded along with the processing fee they had deposited even years back.
The changes in the Immigration rule
Budget Implementation Bill enables the country to legally remove or delete the applications of more than 270,000 people who were planning to reach Canada as Federal Skilled workers before 2008.
There is an assurance from the Government regarding returning the application fee. The applicants are suggested to make a fresh application following the fresh set of rules. These applicants must get prepared with the thought that they won’t be given the facility of “fast tracking” in spite of them waiting for years now.
Immigration Minister’s opinion
Supporting Bill C-38, Citizenship and Immigration Minister, Jason Kenney does not see the possibility of the country dealing with the backlogs waiting for the last couple of years and he feels that it won’t be fair for the immigrants too.
Immigration would take as many as another four to five years’ time to clear the backlogs of application prior to 2008 and then to clear the applications made post 2008 would be another uphill task for the Government.
The Minister though feels sorry for the applicants waiting for their turn, yet he proposes that returning the applications and the fee is the possible solution.
The impact on the applicants
There are applicants who have been waiting to come to Canada for years now. There are some who can plan out their families only if they come to this country. But, they are all stuck due to this latest information. They have been waiting for more than 6 years or so and finally they get to hear about the rejection of their applications.
Their dream of completing their family or providing a better lifestyle and education to their children has almost to an end due to the latest decision made by the Government.
The damages made by the announcement
There were applicants who got the first signal that the processing of their application had begun and suddenly they get to hear about the return and refund.
Experts too fear that the world will get an impression that Canada asks applicants to submit the documents, ask them to wait for years and finally informs them about the refund and rejection of the application.
In quite a number of cases, a few important steps of processing were done including police verification and collection of identity certificates. This left the applicant with a big hope of getting a visa in no time. But, the latest announcement has dashed their hope and has left them in pain.
Hope falls flat
Many of the applicants were assured by the Visa officers about their turn coming soon to them. In a query of making an application under a different category the applicants were assured that the processing of forms would take place soon so there was no need of doing so.
As many as 40 applicants from countries like China and Hong Kong have filed a suit against Canadian Government for making such a devastating decision.
An Immigration Lawyer supporting this move says that the applicants have every right to move the court against Government of Canada because the applicants were had followed every single instruction passed by the Immigration officials. In many cases they had collected required documents from their employers and from wherever they were asked to get the visa. But at the end all they got was “denial”.
In spite of a big refusal coming from Canadian Government the applicants still hold a faith that they could get justice in the days to come.
