In what has been called as a landmark ruling, the Federal Court of Appeal has reaffirmed the Canadian Society of Immigration Consultants (CISC) as the ruling regulating body for the Canadian immigration consultants.
Speaking about the decision, the Federal Court said that the Immigration Consultants will play a valuable role in helping individuals who are caught up in the immigration system. The Federal Court of Appeal also branded the organization as the gatekeeper of the profession of immigration consultants.
The controversial case first came to the frame after the Law Society of Upper Canada decided to implement legal action on the CSIC, the Minister of Citizenship and Immigration (CIC) and the Attorney General of Canada. Their motive behind the movement was the contention of the authority of CSIC to regulate immigration consultants.
Despite this action by the Law Society of Upper Canada, the Federal Court ruled in favour of the CSIC and also established its opinion that such a body can be of immense benefit to the immigrants who are willing to live, work or study in Canada.
The official ruling stated that it is absolutely correct on the Minister’s part to take initiative in designing and putting in place the legal, financial and institutional means that is aimed at tackling serious public policy issues that is presented by unregulated immigration consultants. Thus, the court stated that the Minister’s step to create the CSIC is appropriate.
It should be noted that the CSIC is an independent body and it is mainly responsible of regulating the activities of immigration consultants who are members and who provide advice on immigration by taking fee for the same.
Tabitha Holland, who is a Canadian immigration consultant and also a registered CSIC client, said that the decision was a step forward for Canadian immigration as a whole and marked that this would be viewed in a positive way throughout the industry.
With immigration numbers steadily growing in recent years, the immigration issues in Canada has gained increased publicity. In order to attract skilled immigrants to the country, the immigration department of Canada has also been actively involved with promoting the country. All this is being done in order to relieve the current crisis of declining skills pool and the aging Canadian population.
Speaking of the decision, the CSIC’s Chairman John Ryan said that the new is a terrific one for the CSIC and the ultimate winner has been the consumer of immigration services.
