An HIV-infected stripper who infected her husband faces a possible deportation from Canada after she was convicted of criminal negligence and aggravated assault for knowingly passing the AIDS causing virus.
In a ruling released on Tuesday, the Federal Court dismissed a challenge from Suwalee Iamkhong, who came to Canada from Hong Kong in 1995 on a work visa and was here to work as an exotic dancer in Toronto.
Iamkhong, who is originally from Thailand, met Canadian Percy Whiteman soon after she arrived in Canada and then married him in 1997.
She had already tested positive for HIV in Hong Kong, but she did not revealed her status to her husband until she fell ill in 2004 and had to be hospitalized.
39-year old Iamkhong was sentenced in August 2007 to three years in prison after being convicted of criminal negligence causing bodily harm and aggravated assault.
Federal Court Justice Russel Zinn ruled against Iamkhong in her challenge to a report prepared by Immigration officials and which found her inadmissiable to Canada on the grounds of having a criminal record that garnered a sentence of more than two years- three years in her case.
As per the law, a report must be prepared for the federal immigration minister before he makes a decision on whether to deport or not.
Zinn noted that non-citizens can be removed from Canada if the person has been convicted of serious criminality, which in this case the applicant has and so she should be deported.
